Box 2329 Denver, 00 80201 Re: 40 Acre Open Pit Cla;~ t:sne, Section 27, T1S, R70~Y, Ibrothy Jenkins Lease Dear Mr. Spence In order to assist the Denver Brick & Pipe Company in obtaining a permit from the Colorado Diined Land Reclamation Board, the Boulder County Zoning Department formally recognizes the existence of a 40 acre open mining operation authorized under land use permit #:9315 on September 8, 1966. Certified tonnages of clay purchased from the Jenkins pit averaged 4,410 tons per fiscal year from 1961 through 1978 with 1962, 1963 and 1°.65 • being years of abandonment. Since the open mining special use amendment was effective on July 8, 1976, of continuous legal non-conforming use status has been maintained with records of operation certified by George Y7. Stock Jr., Chief Accountant, for the Denver Brick & Pipe Canpany. Any future expansion or enlarga~ent of operations, however, beyond the original 40 acres recognized for the 1966 use permit shall be authorized only through the current Special Use Permit process. The area to be considered for the purposes of "grandfathered" mining practices and for a reclamation permit is the 40 acres described in the W~, SE;, SEa and the E?, SW;, SEA of Section ~7, T1S, 870.7. The above information is being sent. to the Colorado f,4ined Land Reclamation Board as a check for conformity in the legal descriptions of the site and to expedite the release of your reclamation permit.
