The portion omitted was then not
detected by the Delta County Planning Department and the plat was
recorded. I have enclosed a copy of both the recorded final plat and
the prepared Revised Plaf of Volk Minor Subdivision which clearly shows
the difference in the lot size of Lot #2.
I am the new County Planner and I will give you a brief history of the
processing of your No Impact Minor Subdivision as I understand. First of all
you applied for a No Impact Minor Subdivision on November 14, 1997 and
in your application you clearly stated, "The proposed split will contain two
parcels. Parcel # 1 containing approximately 22 +!-, the residence and
out buildings will be separated from the remaining land. Parcel #2 will
remain agricultural in nature and contains approximately 87 +/- acres
(copy attached)". The application further states the lot sizes for Lot # 1 is
22 +/- acres and Lot #2 is 87 +/-acres.
Phil Seiber presented your application to the Board of County
Commissioners on November 14, 1999. I have enclosed a copy of the
minutes of the Board of County Commissioners meeting which indicates
that you were creating two lots; Loi # 1 approximately 27 acres and Lot #2
approximately 87 acres. It further stotes; "This subdivision appears to meet
the criteria for a No Impact process in that Lot 1 contains an existing
residence and outbuildings and Lot 2 will be restricted 1o agricultural use".
Volk Minor Subdivision 97-071 was approved by the Board of County
Commissioners with Planning Staff recommendations.
