I am Medi11 Barnes, Manager for the Silver Dollar Metropolitan District, a <br />quasi-municipal corporation and political subdivision of the State of Colorado <br />(the "District"). I oversee the construction and maintenance of projects as <br />directed by the district board of directors. <br />2. I have served in this position for the District since the District was formed on <br />December 6, 2000. <br />3. The statements contained in this affidavit are based upon my personal <br />knowledge. <br />4. I have been made aware of the MMRR Quarry application pending before the <br />Calorado Division of Minerals and Geology by newspaper accounts and word of <br />mouth. <br />5. The District installed in cooperation with CDOT light poles and associated <br />wiring and conduit along Highway 119 extending from the intersection with US <br />6 to the city limits of the City of Blaclc Hawk, primarily to improve safety of <br />night travel. <br />6. Conduit, wiring, and approximately four of these poles are within 200 feet of <br />land that will be affected by the proposed mining operation, according to the <br />location of the proposed mine and access road contained in the application on <br />file with the Colorado Division of Minerals and Geology. <br />7. These light poles are permanent, valuable structures that have a significant <br />value to the District. Each pole has an estimated value of $5,000. <br />8. Additionally the cost of the conduit and wiring buried through the affected area <br />is valued at $20,000. <br />9. The District has not been mailed or personally served a notice of the pending <br />application by the applicant. <br />10. The applicant has in no way specifically or purposefully informed the District of <br />the pending application. <br />
