I, Medill Barnes, being duly sworn, state as follows:
1. I am Medi11 Barnes, Manager for the Silver Dollar Metropolitan District, a
quasi-municipal corporation and political subdivision of the State of Colorado
(the "District"). I oversee the construction and maintenance of projects as
directed by the district board of directors.
2. I have served in this position for the District since the District was formed on
December 6, 2000.
3. The statements contained in this affidavit are based upon my personal
knowledge.
4. I have been made aware of the MMRR Quarry application pending before the
Calorado Division of Minerals and Geology by newspaper accounts and word of
mouth.
5. The District installed in cooperation with CDOT light poles and associated
wiring and conduit along Highway 119 extending from the intersection with US
6 to the city limits of the City of Blaclc Hawk, primarily to improve safety of
night travel.
6. Conduit, wiring, and approximately four of these poles are within 200 feet of
land that will be affected by the proposed mining operation, according to the
location of the proposed mine and access road contained in the application on
file with the Colorado Division of Minerals and Geology.
7. These light poles are permanent, valuable structures that have a significant
value to the District. Each pole has an estimated value of $5,000.
8. Additionally the cost of the conduit and wiring buried through the affected area
is valued at $20,000.
9. The District has not been mailed or personally served a notice of the pending
application by the applicant.
10. The applicant has in no way specifically or purposefully informed the District of
the pending application.
