Parker <br />Peter F. Waltz <br />As you know, this firm represents the City of Black Hawk, which as been made a party to <br />proceedings related to your File No. M-2004-067. On behalf of the Mayor and Board of <br />Aldermen, please let this correspondence serve as the City's reply to the applicant's August 19, <br />2005, response to the Division of Minerals and Geology (the "Division") second adequacy <br />review of the permit application. <br />The City would like to point out several reasons why the application, even as amended, <br />revised, and supplemented, fails to meet the statutory and regulatory requirements that control <br />the Division's issuance of regular 112 permit application. <br />1. Location of access road. <br />The latitude and longitude coordinates (lat. 39.76639 (deg) N, long. 105.41278 (deg) W) <br />for the current proposed access road that applicant provided in the August 19, 2005, response are <br />inaccurate. The coordinates provided do not match up to any point along Highway 119. <br />Therefore, the requirements of CMR 6.4.1(2) have not been met. In addition, neither the <br />Division nor any objector may effectively determine where the access road will be located or <br />what property owners and man-made structures may be affected by its construction.
