The County is concerned with Applicant's non-compliance with 112 pemutting requirements <br />in several respects. <br />First, the Division and Mined Land Reclamation Boazd should be awaze of the Applicants <br />continuing failure (or refusal) to comply with Gilpin County Zoning Regulations governing the off <br />site impacts of the proposed quarry operation. MLRB rules require that the Application contain a <br />statement that the Applicant has applied "for all necessary approvals from local government" (Rule <br />I.4.1(5)(d). As detailed below, Applicant cannot truthfully make any such statement. <br />Second, the pending Application contains erroneous information, which mandates the filing <br />of an amended Application. The point of access to State Highway 119 specified in the current <br />Application has been denied by the County, as issuing agency for such permits. A different access <br />point is now under consideration by the County. This change in the point of access will necessitate <br />the filing of a second amended Application, with notice, and publication. <br />Local Government Annrovals. <br />Gilpin County Zoning Regulations, 6.1 prescribe the following special use permit <br />requirements: <br />
