Z1S <br />Denver., Co 80203 <br />RE: Gilpin County Reply to August 18, 2005 Response by Applicant to 2nd <br />Adequacy Review (Permit Application M-2004-067) <br />Dear Mr. Schreiner: <br />'T'his reply is submitted ou behalf of the County of Gilpin, a party to the proceedings in this <br />matter. The Country is concerned with Applicant's non-compliance with 112 permitting requirements <br />in several respects. <br />rirst, the'Division and Mined Land Reclamation Board should be aware of the Applicants <br />continuing fai lure (or refusal) to comply with Gilpin County "Coning Regulations goventing the off <br />site impacts of the proposed quarry operation. MLRA rules require that the Application contain a <br />statement that the Applicant has applied "for all necessary approvals from local government" (Rule <br />1.4.1(5}(d). As detailed below, Applicant cannot truthfully make any such statement. <br />Second, the pending Application contains erroneous information, which mandates the filing <br />of an amended Application. The point of access to State Highway 119 specified in the current <br />Application has been denied by the County, as issuing agency for such pennies. A different access <br />poink is now under consideration by the County, This change in the point of access will necessitate <br />the filing oP a second amended Application, with notice and publication. <br />Local Government Annrovals. <br />Gilpin County Zoning Regulations, b.l prescribe the following special use permit <br />rcquiren~cnts: <br />Exhibit C <br />
