I[ appears <br />that all issues have been addressed to meet the minimum requirements of the Act and Rules. The final issue prior to a <br />decision is the agreement on the Initial Reclamation Liability. <br />Please find attached staff's estimate for the costs for initial reclamation. There is a substantial difference between the final <br />sum submitted in Exhibit L and staff s. Several factors add up to the discrepancy. <br />]) The pit will have to be pumped almost dry not half way as estimated in Exhibit L. To establish 3:1 slopes on the <br />west end the material must be compacted from the toe of the slope~up prior to any significant water saturation. <br />2) The Reclamation Plan states 15 to 18" of topsoil are to be replaced. Exhibit L notes only 8. Staff must go by what <br />the plan notes and with the most conservative of the estimate range. <br />3) Given the amount of topsoil to be replaced and distance to move it, scrapers will need to be utilized, not a dozer. <br />Given the fact that the equipment will be on site for overburden movement [o slopes there is no additional costs for <br />mobilization, etc. <br />4) Staff must assume that the entire processing area will be utilized and therefore must be top soiled and revegetated. <br />This adds to the total area of disturbance in the worst case scenario noted in Exhibit L. <br />Other costs differentials appear to be more due to inflationary costs, etc. but added up. Please review the estimate and feel <br />free to contact staff if there are issues or errors. As a reminder, the Decision Date is May 17`", 2007. If the estimate is <br />acceptable, please call staff as soon as possible so the Decision Date can be met.
