Simpson, Assistant State Engineer <br />SUBJECT': Weld County Department of Engineering - Lehr Pit <br />Application for Mining and Reclamation Permit, Ji83-21~i <br />As requested, we have reviewed the above referenced application for a dry pit <br />northwest of Nunn. The application indicates that water for the operation will <br />be obtained by permission from stock water ponds or springs in the area, or <br />hauled from the County Shops in Greeley. Weld County cannot legally divert <br />water from the stock water ponds unless the ponds are decreed to allow the <br />mining use. Water may only be diverted from springs when there is not a call <br />on the South Platte Basin. <br />We would not object to this operation if Weld County obtains its water from a <br />source which allows the use of water in the mining operation and complies with <br />other applicable water statutes. <br />[-@S/JRH:ma <br />cc: Jim Clark, Div.
