Rd. 18 Ronald w. cottony <br />Holyoke, CO 80734 Division Director <br /> NaNral Resource Trustee <br />,/ <br />RE: Mike Bennett; File No. M-2007-621 <br />Bennett Pit Pit; Adequacy Review <br />Dear Mr. Bennett, <br />Listed below aze adequacy review comments for the Bennett Pit 110 Application, File No. M-2007-021. <br />The Division of Reclamation, Mining and Safety (Division) is required to make an approval or denial <br />decision no later than May 13, 2007, therefore, your response to the following adequacy review concerns <br />should be submitted to the Division as soon as possible. <br />1. As required by Rule 1.6.2(1)(d), please submit the proof of publication of the public notice circulated <br />in the local newspaper, all owners of record of surface lands that are within 200 feet of the boundary <br />of the affected land, and any easement holders. Proof of notice maybe return receipts of a Certified <br />Mailing or by proof of personal service. <br />2. Rule 6.3.2 Exhibit B- Site Description <br />The applicant states that an existing pit is already located on site and that Mr. Bennett should not <br />be held to creating a 3"1 slope back to the wedge of the right-of--way of Road BB. Please further <br />explain the existing pit and the various slopes. Please provide photographs and detailed drawings <br />on one if the exhibits of the disturbed azea. Please be awaze that if the slopes are re-affected by <br />Mr. Bennett during the proposed operation, then reclamation of the slope under this permit would <br />be required. <br />The latitude/longitude data provided by the applicant on the application form does not property <br />field locate the site. Please review the location, and provide accurate coordinates to locate the <br />site. <br />3. Rule 6.3.3 Exhibit C- Mining Plan Please address the following items in the mining plan; <br />• The applicant states that the topsoil piles will be seeded to prevent soil erosion.
