This notice is pursuant to rule 3.1.5. <br />paragraph 9. The subject material is located at Spruce Hills, which is just south of <br />Fairplay on highway 9. We anticipate moving this material during the week of May 6, <br />2002 and completion would be during that time period. We will resale the material than <br />we remove. The material is inert and consists mostly of screened cobble. I hope that this <br />letter will also constitute my affidavit of fact that the material is inert. <br />Sincerely, <br />K.
