My name is Rickie L. River and I am a property
owner north-east of the proposed i{iowa Clay Mine. Our physical address is: 26753
County Road 89-93 Ramah, Colorado. I also need to explain why I have not rosponded
before now. We wets set to put our house on the market to sell because of my husband's
health problems. I was totally unaware that Acme Brick was going to start mining the
property next door until a sign was posted on the fence a few weeks ago. I contacted the
real estate agent that was going to list our home with my concerns and he said to say and
do nothing. I have tried tb make a decision about this and can NOT sit back and do
nothing. I can not do what Acme $rick has done to all of the property owners here. I can
not sell this house to someone and let them be tutawar>r as to what is going tv happen. Tt
is really sad that Acme Brick could not send all property owner directly affected by their
operation as to their intentions, since there are only eight of us. I really do not understand
why they can not let us know in writing what they intend to do, but we have to write
letters, make phor~ calls and drive to get the information we need to make a decision.
This is a dirt road and truck traffic will definitely affect how we live and what our
property is worth. No person is going to buy a home an speculation. I cumernly do vat
know what is going to happen because no one has the same story.
How can anyone believe Acme Brick when they have difficulty disclosing they true
intentions from the startT They say they are going to keep our road maintained but they
don't do that at their other mine. One person says they are going to mine oNy one month
a year and another says eventually the mine will be in full operation in a few years and it
will run 6 months out of the year. The trucks will rutt from 6:00 am to 9:00 pm six days a
week Banks and Gesso says they are within the law but I would like just a little bit
more. The whole truth would be nice since my crystal ball just hasn't been working
Lately.
I also have a couple of concerns and a question. Since the original permit belonged to
Denver Brick and Denver Brick sold the property to Acme Bock why does Acme Brick
vat have to apply for a whole new permit with Elbert CoumyT If a private land owner
sold a property the new owner would have to do so, wouldn't they?
I also have great concern with the road situation. I have lived here for a few years now
and before the new road base vehicles would flip at my confer and end up upside down in
the ditch. Well, with heavy truck traffic it won't be long before the road base will be
destroyed and I'll be back to calling 91 I. Next, the trucks have to enter back onto
Highway 86 to go back to Castle Rock. Is Acme $rick going to install a traffic signal at
ovr intersection since looking to the west is completely biind7 if you are going east no
02
