• • <br />Reclamation Act of 1973, Any violation of any state regulation <br />or statutes relating to this operation shall be grounds for <br />immediate termination of this permit. <br />8. Rehabilitation of Site: Clayton and Son Construc- <br />tion Co. has represented to the Board of County Commissioners that <br />the excavations created by this operation will be rehabilitated <br />and reclaimed pursuant to the requirements of the Colorado Open <br />Mining Land Reclamation Act of 1973. Specifically, permitee has <br />represented that in its application to the State of Colorado for <br />a permit to conduct this gravel extraction operation it will enter <br />into a land stabilization and reclamation agreement in the form <br />set forth in the attached Exhibit "A", which by this reference is <br />incorporated herein and made a part hereof. permitee, by signing <br />this agreement, does ktereby make the same representations and com- <br />mitments to the Board of. County Commissioners of Grand County <br />regarding the stabilization and reclamation of this site. <br />9. Bond: In order to insure the performance of the <br />reclamation and stabilization plan proposed by the permitee, as <br />,set forth in the attached Exhibit "A", permitee shall furnish to the <br />Board of County Commissioners of Grand County a performance bond <br />:in the amount of Fifteen Thousand Dollars ($15,000.00) to insure <br />i:hat the work required by said agreement will be accomplished. <br />10. Limitation of Liability: The Board of County Com- <br />ntissioners by the issuance of this permit assumes no responsibility <br />t:or the operation of the site and the Clayton and Son Construction <br />C'o. hereby covenants and agrees to hold Grand County harmless for. <br />a.ny injury or damage which may occur, of whatever type or nature, <br />as the result of the operation contemplated by this permit. Clayton <br />and Son Construction Co, warrants that it will obtain appropriate <br />liability and hazard insurance to compensate any individuals who <br />may be injured or damaged in any manner by the conduct o.f_ this <br />business. permitee further warrants and agrees to compensate Grand <br />County for any expense incurred in the defense of any lawsuit or <br />_5_ <br /> <br />
