You requested an extension of 30 days. I am approving this request, and the new decision date has been set <br />for April 17, 2002. <br />I have reviewed the packet of adequacy response materials you submitted on March 13, 2002, on behalf of the <br />applicant, Bridalveil Construction. Most of the material adequately addressed the issues, though there are still a <br />few items still needing to be further addressed. I have listed these remaining items below, and have used the same <br />numbering of the individual items in my first letter. Please arrange and number your responses in the same manner. <br />Exhibit C -Mining Plan <br />12. The plan includes performing earthwork to rite "chatmel" of the creek, to straighten and deepen it, and provide <br />a sediment trap toward the bottom of the hill, all within the permit area. Below the sediment trap will be designed <br />with an engineered outlet to a natural channel, leading to a borrow ditch in the CDOT easement. If sediment from <br />the channel is not adequately controlled in the trap, and leaves the permit area, this operation may be subject to the <br />requirement for a stormwater management permit or dischazge permit from the Water Quality Control Division <br />(WQCD). Please ensure that sufficient capacity is constructed into the trap, and that the trap and other sediment <br />control structures are adequately maintained during the operation. If not, you may be required to provide evidence <br />of contact with the WQCD. <br />Please ensure that slopes are graded in other disturbed portions of the permit azea such that they do not contribute to <br />offsite runoff of stormwater or sediment. <br />14. The existing road will be used to access the lower bench during the initial phase of mining. The existing road <br />in included in the permit area. At a later time the socond road will be constructed to access the upper portions of <br />the site. This second road is not included in the 3.64 acres of permit azea, but must be added before it can be built. <br />It would have been easier to have included the land for this second road in the permit application, even if the road <br />might not be built for years, than to add it later. Adding land to a permit area is normally through an amendment to <br />the permit. Please contact this office to discuss how to request a permit amendment when the additional land is <br />needed. <br />
