COUNTY OF ROUTT ) • III III III IIIIIIIIII R~LUTION RE: SPECIAL USE PERM11IT <br />" >ss. sss TO EXPAND MESA GRAVEL PIT <br />STATE OF COLORADO) PEABODY COAL COMPANY <br />WHEREAS, the Board of County Commissioners for the County of Routt, State <br />of Colorado, has duly received a petition from Peabody Coal Company to expand <br />the Mesa Gravel Pit to 93.7 acres from 9.95 acres in an Agriculture/Forestry <br />(AF) zone district; <br />WHEREAS, all necessary data has been submitted and all required fees have <br />been paid on behalf of the petitioner; <br />WHEREAS, the petition has been received by the Routt County Regional <br />Planning Commission which has submitted an advisory report recommending approval <br />subject to the following conditions: <br />I. A bond should be submitted to Routt County in an amount to be <br />+ determined by the Board of County Commissioners for damage to <br />private and public property (drainage ditches, fences, bridges, <br />roads, etc.) <br />2. County roads used for the hauling of gravel must be able to accom- <br />modate the proposed additional traffic. All haulage roads must have <br />adequate signage at intersections and any other locations which may <br />require additional signage. All relocated County roads must have <br />adequate dedicated right-of-way and must meet, at a minimum, County <br />road standards. <br />3. All road and bridge repair and maintenance agreements made with <br />the County prior to permit issuance must be adhered to. <br />4. This Special Use Permit limits use to extraction only. Any additional <br />facilities or operations not presented in the original mining opera- <br />tion plan are not allowed without approval from the Board of County <br />Commissioners. <br />5. The Special Use Permit is in effect until termination of active <br />production or for the life of the mine, whichever comes first, pro- <br />viding all mining conditions are complied with throughout the <br />mine's operation. <br />6. All sand and gravel Special Use Permits will be reviewed every three <br />years to ensure compliance with all terms of the Special Use Permit. <br />7. Hauling shall take place on State or Federal Highways, when possible, <br />when hauling roads are not used. <br />8. Sanitary facilities are to be located on or near the extraction site. <br />9. Effective weed control is to be exercised on the total area. <br />10. Mitigation measures for cessation of operations during critical <br />periods for the Greater Sandhill Cranes should be implemented if <br />deemed necessary by the Colorado Division of Wildlife. <br />II. An agreement with the Hayden School District concerning the hauling <br />of gravel during the hours that school buses are running should be <br />formalized. <br />12. The finalized agreement between Peabody Coal and the Power Company <br />concerning the distance of removal of gravel around the power lines <br />should be submitted to the Planning Department. <br />13. Mitigation for dust control should be addressed. <br />14. A revised reclamation plan showing that the original contours on the <br />mined land will be maintained so that the same amount of drainage <br />will return to the Craig Weaver water basin. <br /> <br />
