Please state, pwsuant to Section 2.03.4(6)(6), whether there are any <br />holders of record of leasehold interest in the property or coal to be mined by swface coal <br />mining activities, or for underground mining activities, in the azea to be affected by <br />surface operations and facilities incidental there to. <br />23. Several pages of compliance information were provided in Exhibit 1, pages 96-135. <br />Please provide the information required by Sections 2.03.5(3)(c), (d), (e), and (f). <br />24. Please provide a metes and bounds description of the proposed permit boundary (Section <br />2.03.6(1)). This could possibly be obtained from pertinent sections of the various tract <br />descriptions provided in Exhibit 2. <br />25. The proposed Lorencito Canyon railroad spw and loadout aze discussed on pages 2.05-30 <br />and 2.05-40. Please provide a description of the documents upon which Lorencito Coal <br />Company bases its right to construct the junction of the spw to the main rail line, its right <br />to shuttle coal by train from the Lorencito Canyon Mine to the New Elk processing <br />facility, and its right to transport processed coal from the New Elk facility to the City of <br />Trinidad. Please enswe, pwsuant to Section 2.03.6 of the Board's Regulations, that this <br />description identifies these documents by type and date of execution, identifies the specific <br />lands to which these documents pertain, explains the legal rights claimed by the applicant, <br />and discusses whether those rights aze the subject of pending litigation. <br />26. It is stated on page 2.03-7 of the application that Lorencito Coal Company does not intend <br />to conduct surface mining activities, or to conduct or locate swface operations or <br />facilities, within 300 feet of an occupied dwelling. Please also state, pwsuant to Section <br />2.07.6(2)(d)(iii)(B) of the Regulations, whether the proposed life of mine affected azea <br />will exist on lands within 300 feet measwed horizontally of any public building (Section <br />1.04(101)), school, chwch, community building (Section 1.04(27)), institutional building <br />or public pazk (Section 1.04(103)), or on lands within 100 feet measwed horizontally of <br />a cemetery. <br />27. Pwsuant to Sections 2.03.7 and 2.07.6(2)(d)(iv) of the Regulations, please state whether <br />the proposed life of mine affected azea will exist on lands within 100 feet, measwed <br />horizontally of the outside right-of--way line of any public road, except where mine access <br />roads or haul roads join such right-of--way line or where the relocation or closwe of any <br />public road is proposed. <br />28. With regazd to other licenses and permits (application page 2.03-7 and Table 2.03.10-1), <br />will an explosives permit also be required? <br />Rule 2.04.3 Site Description and Land Use Information. <br />29. The Premine Land Use Map 2.04.3-1 shows land use on adjacent lands to the North of <br />the Permit area as being "Cropland" and "Hay Meadow".
