OF LLATURAL RESOURCES RE: Application for Permit to Conduct Coal Mining in Colorado Dear Mr, Shelton: Northern Coal Company (Northern) is submitting the enclosed application in order to comply with the State program which became effective on December 15, 1980. The application form references the Meeker Area Mines Application which was submitted to the State on Jvne 16, 1980. The application covers the expansion of the existing Rienau No. 2 and Northern No, 1 Mines as well as the development of the Northern No. 2 and No. 3 Mines which are planned. The application also covers continued use of our present Wilson-Loudy Loadout and the construction of a new Loadout called Milk Creek. We have had discussions with your staff concerning the review of this application. To date, the Office of Surface Mining has reviewed the plan and sent Northern an apparent completeness letter, We are in the process of preparing a response to that letter now. It is our under- standing that the State will be the lead for further review of the application. One issue that should initially be addressed is that of the application fee, The application calls for a 5 year permit of the entire complex which covers 1417 acres. Using the formula in the new State program, this would require the maximum fee of $2500,00. The June 16, 1980 sub- mission was calculated under the old State regulation formula and the application fee at that time was $1161.50. Therefore, we have sub- tracted that amount from the required $2500,00 maximum under the new regulations and we are submitting a check in the amount of $888.50 to cover application fees.
