<br />-4- <br />2. The applicant has not addressed the requirement of Rule 4.70.4 for <br />placing four feet of the best available, non-toxic, non-combustible material <br />on the coal processing waste pile. The only mention 1s that two feet of <br />topsoil will be placed on the pile. There 1s no evidence provided that this <br />is sufficient cover to meet revegetatlon success standards. The permit <br />application must be updated with the appropriate Information. <br />Underground Development Waste - Rule 2.05.3(9) <br />1. Because of the hydraulic mining technique proposed, all normal <br />underground development waste, such as partings, splits and roof and floor <br />rock, will be separated from product coal as processing waste and ts, <br />therefore, appropriately addressed under Rule 2.05.3(8). However, the Initial <br />portal and mine access development Involves the construction of parallel <br />2,500' long rock tunnels, which will produce approximately 25,000 cubic yards <br />of underground development. The applicant falls to present any discussion of <br />the disposition of this and any other expected underground development waste <br />materials. <br />Reclamation Plan - Rule 2.05.4 <br />1. The application does not contain any post-mining contour maps or <br />cross-sections. These must be incorporated into the permit application in <br />accordance with Rule 2.05.4(2)(c). <br />2. The application contains no detailed timetable for the completion of <br />each major phase of the reclamation process. A timetable addressing the <br />requirements of Rule 2.05.4(2)(a) must be incorporated into the permit <br />application. <br />3. The application contains no descriptions or drawings showing the <br />measures that will be taken to seal the mine openings and drill holes as <br />required by Rule 2.05.4(2)(8). <br />Post-Mining Land Use - Rule 2.05.5 <br />1. Landowner comments on the post-mining land use are stated on page 4-78 <br />of Volume 1 of the application to be in Appendix 4.4-1. This section is <br />blank. The permit appllcatlon must be updated to include these comments. <br />Alluvial Valley Floors - Rule 2.06.8 <br />1. The application contains no map of lands that are currently or were <br />historically flood irrigated, showing the location of each diversion <br />structure, ditch, dam and related reservoir and topography of those lands as <br />required by Rule 2.06.8(3)(b)(1i). This map must be submitted 1n order for <br />the appllcatlon to found complete. <br />
