S ., :i.,. <br />sl:~ z r 1919 <br />P~iINED LAID NECLA^fi r~,.~ <br />We have performed a review of the mining and ruclawatlon plan proposed fn[ [he <br />Orchard Valley Ptlne prepared by Colorado L1esCmoreland and which was received <br />by the Office of Surface Mining (OSI1) on .lone 1R, 1979. The review was <br />conducted [o determine, pursuant [n Title 30 Code of Federal Regulations, <br />Parts 740 and 74.1 (30 CFR 740 and 741), IE the application was complete. <br />Since the plan addresses mining new areas; it must comply with [he <br />requirements of 30 CFR Section 741.13, Par[ 742, and Part 744. We recognize <br />that there are ongoing discussions of the possibility of deferring <br />implementation of the Federal lands prop,ram to mesh with S[a[e program <br />approvals. I am certain you will wish to plan for compliance with [he <br />permanent regulatory program. <br />Our review shows that: the application is not complete in terms of federal <br />requirements. Our review lncurpora[es the reviews of other Federal agencies <br />and has been coordLnated with the Colorado Mined Land Reclamation Division. <br />Inadequate information exists in the applica[lor. to enable the regulatory <br />authority [u make [he necessary flndlnps• Ilowever, we do find the plan; to <br />[he degree 1[ has satisfied [hc rcqulroments, to he nrgnntzcd and presented in <br />nn excellent manner.
