<br /> <br />Rule 2.04.7(1)(a) states that the proposed permit area and the <br />adjacent area need to be considered for the ground water <br />description. Adjacent area is defined in Rule 1.04(6) as being <br />land that will be affected by mining, depending on the context <br />of the subject. In the case of underground mining, where <br />ground water drawdown and contamination may extend a <br />considerable distance from the permit area, the ground water <br />investigation may need to be conducted outside of the permit <br />area. Please provide the reasons for not having the ground <br />water studies conducted outside of the permit area. <br />3. On page 2.04-23 of the permit application, three wells are <br />mentioned as having been drilled into the North Fork of the <br />Gunnison River alluvium. Are these three wells located on a <br />map? If not, please do so. <br />4. Map 24, Alluvial Valley Floor, shows the areal extent of the <br />alluvial valley floor (AVF) immediately adjacent to the North <br />Fork of the Gunnison and immediately adjacent to the permit <br />area. The alluvium of the North Fork of the Gunnison is <br />discussed on page 2.04-23, but no mention is made of it being <br />an AVF. Please provide information, pursuant to Rule 4.24.2, <br />that demonstrates that mining will not diminish the hydrologic <br />functions of an AVF that is not within the permit area. <br />5. On page 2.04-26, reference is made to a table called "Static <br />Water Levels in Exploration Drill Holes", presumably found in <br />Exhibit 4 of Volume III. However, Exhibit 4 only has climatic <br />data. Please locate this table and change the reference <br />accordingly. <br />6. On page 2.04-37, concerning the use of streams, springs and <br />ponds by wildlife, it is stated that mining could negatively <br />impact the springs and ponds in the area. It is further stated <br />that, should a pond be impacted, then the operator will <br />mitigate the impact. <br />The Division has two comments concerning wildlife impacts due <br />to mining. First, as stated above, the Division believes that <br />streams inside or outside the permit area, could also be <br />negatively impacted by mining, and this impact would need to <br />be mitigated. Second, the Division considers negative impacts <br />to springs to be an impact that also needs to be mitigated. <br />Rule 2.04.7(3) states that alternative water sources must be <br />used to augment a water source for "domestic, agricultural, <br />industrial, fish and wildlife, or other legitimate use" that <br />has been negatively impacted. <br />2.05.3 OPERATION PLAN - PERMIT AREA <br />2.05.3(41 PONDS.
