Olson <br />Box 653 <br />Hayden, Colorado 81639 <br />RE: Seneca II W Mine, Our File No. C-057-82 <br />Dear Mr. Olson: <br />Pursuant to section 34-33-114 of the Colorado Surface Coal Mining Reclamation <br />Act, this letter is to inform you of the Mined Land Reclamation Division's <br />proposed decision to approve a permit for a surface coal mining operation. <br />The operation in question is Peabody Coal Company's Seneca II W Mine and <br />associated haul road. <br />Enclosed is a copy of the "Proposed Decision and Findings of Compliance" for <br />this mine. Peabody Coal Company submitted information with the permit <br />application showing the Olson Spring, registered in your name, as a water <br />right for domestic and livestock watering purposes downstream of mining. <br />Under Section VII, Water Rights and Replacement (Pg 23), the Division has made <br />a finding that the operation could potentially result in degradation of the <br />water quality of this water right.
