<br />-2- <br />A stability analysis, based upon a technique developed by Yang H. Huang of the <br />University of Kentucky's Mine Research Center, projects an analytical static <br />slope stability safety factor in excess of the required 1.5. In light of <br />material assumptions made and the absence of underground development waste, <br />the applicant has committed to testing the actual material to verify material <br />strength values. On page 85 of the amended permit application documents, the <br />operator states: <br />"Final design of the spoil pile will be completed when representative <br />samples of the actual spoil can be tested, but before the spoil level <br />reaches the top of the toe dike." <br />XX.
