On July 23, 1984, I received a <br />response from her office stating that there were no known cultural resources <br />located in our permit area. She suggested that I contact Foster Kirby at OSM <br />before undertaking any cultural resources. <br />On October 10, 1984, I sent a letter to Mr. Kirby requesting a list of <br />companies who were authorized to do this work and also to solicit any infor- <br />mation OSM would like to see included in a cultural survey. I received a <br />response to this letter on January 10, 1985. <br />In November, I decided to retain a consultant to look at our stipulation. <br />I had Mr. Bill Biggs of Archaeological Consultants, Durango, Colorado look over <br />the stipulation and maps of our area to determine if it was possible to prepare <br />a "negative declaration of findings" in order to satisfy the stipulation. At <br />that time, he felt that there was a good possibility of preparing a "negative <br />declaration." While Mr. Biggs was reviewing our problem, I came across an <br />archaeological study done here at the mine site in the fall of 1977. This study <br />is included with this letter for your review. While this study does not include <br />the whole permit area, it does state that there are no cultural resources in a <br />good part of our permit area. <br />Recently Mr. Biggs has talked to the Region II Forest Service representative <br />and 'the State Historical Preservation Officer. Both agencies have stated that <br />given the pertinent information concerning this area (i.e. lack of known cultural <br />resources, previous archaeological study, and topography) a full scale statistical <br />survey is not required. However, a one or two-day spot check is required to <br />verify the absence of cultural resources. <br />-continued- <br />
