This Agreement states the entire agreement between the <br />Parties and replaces all oral and written representations, correspondence and agreements. No <br />• amendment or modification of this Agreement shall be binding unless made by a written <br />instrument executed by both parties. Nothing in this Agreement shall be construed as an <br />obligation of Grantee to construct any road, to continue the Easement for any minimum period <br />of time or to continue to make any minimum payments under this Agreement. If requested by <br />Grantee, Grantor shall execute a metn9randum of this Agreement so that Grantee may provide <br />record notice of the Easement and its rights 6crcundcr, but without disclosure of the payments <br />and other matters which Grantor may consider eonlideotial. Grantor agrees not to record this <br />Agreement. This Agreement shall be construed in accordance with the laws of the State of <br />Colorado.
