Lang <br />Division Director <br />Response to Geotechnical Comment <br />1997 -Fourth Supplemental Response <br />(Permit No: C-96-083) <br />I have reviewed the response letter submitted by James Stover, P.E. of J.E. Stover & <br />Associates, representing Bowie Resources, Ltd. In this letter Mr. Stover responds to the several <br />of the geotechnical adequacy questions contained in my memoranda of January 29, 1997. <br />"Additional Stability Analyses, Proposed Portal Road Cuts and Topsoil Pile" (Memo #1) <br />(1) Geotechnical observer during construction - Mr. Stover has amended the Introductory <br />section of Volume VII to the permit application to clearly state;" A qualified geotechnical <br />observer will be on site during geotechnically sensitive construction operations..." This <br />clarification statement satisfies my earlier concern. <br />(2) Expansive Soils Shear Strength - In response to my request for verification of MAXIM's <br />opinion that sear strength of these soils will be adequate to result in stable reclaimed <br />slopes, MAXIM has conducted consolidation/swell testing of representative soils. These <br />tests have verified their opinion that these soils will not be deleteriously affected by swell. <br />°Geotechnical Laboratory Testing, Proposed Gob Pile" (Memo #2) <br />In response to my earlier suggestion, Mr. Stover has indicated that BRL is willing to accept a <br />stipulation disallowing any construction activity on the gob pile until the Division finds the design <br />to be adequate. WESTEC has mobilized a drill rig to collect another set of Mancos Shale <br />samples at the site. Laboratory testing will be performed to confirm or refute the earlier Maxim <br />testing. <br />With the imposition of such a stipulation my concern would be satisfied. <br />
