Ferguson <br />Natural Resource Consulting DIVISION OF <br />6000 West Mansfield, #15 _ <br />Denver, CO 80235 <br />Subject: Carbon Junction Coal Mine, Durango, La Plata County, Colorado <br />Mr. Ferguson: <br />The Fish and Wildlife Service (Service) has reviewed the information you sent <br />us on the subject coal mine on behalf of the Colorado Division of Minerals and <br />Geology. There are several endangered and candidate species that may occur in <br />the mining area. <br />ENDANGERED SPECIES <br />Bald eagle Haliaeetus leucoceohalus <br />Peregrine falcon Falco oereorinus <br />Colorado squawfish Ptvchocheilus Lucius <br />Razorback sucker Xvrauchen texanus <br />The lower Animas River is a known wintering area for bald eagles. If winter <br />roost trees are located near the mining site activity should be avoided within <br />1/4 mile of the roost between November 15 and March 15. If maintenance work <br />is required in this time frame work should only be conducted between 10:00 <br />a.m. and 2:00 p.m. <br />There are two historical peregrine falcon breeding territories established in <br />1986 that encompass the mining area. Actual nest sites may have shifted since <br />1986 and nests should be searched for prior to activity. No disturbance <br />should be allowed within 1 mile of nesting peregrines between March 15 through <br />July 31. <br />The endangered fishes do not actually occur in the drainages by the mining <br />area but if there is any water depletion associated with mining activities it <br />could impact the endangered fishes in the San Juan River. If there is any <br />depletion to the San Juan River Basin the lead agency should enter formal <br />consultation with the Service. Also, contaminants created by mining activity <br />could impact the fishes and should be detained by retention ponds or other <br />means. <br />
