Special attention will be given to areas where
known archeological resources are present. If subsidence is determined
to be affecting cultural resources, the BLM Area Manager will be notified
and appropriate measures will be taken in consultation with the State
Historic Preservation Officer to mitigate its effect."
The intention of this stipulation is to safeguard known areas of fragile
archeological resources from the potential impact of subsidence, an
occurrence which is hard to predict in exact location and severity.
Hocaever, comments received both from your office and that of Powderhorn
Coal Co. indicate that this stipulation would be difficult to implement
logistically and that it is in excess of what is needed for site protection.
Therefore, Stipulation Number 1 is now changed to read:
"Where underground mining is to take place, monitoring for impact
to known site locations will be required in those areas where
subsidence has been determined to be occurring, or where there is
a possibility that it may be occurring. All monitoring of sites
is to be carried out by a qualified archeologist. If subsidence
is determined to be affecting cultural resources, the BLM Area
Pfanager will be notified and appropriate measures will be taken
in consultation with the State Historic Preservation Officer to
mitigate its effect."
