<br />The facilities shall be designed, con- <br />structed and maintained to contain or <br />treat the volume of water from active <br />mininy areas, preparation plants. and <br />associated areas which would result <br />from a 10-yearn 24-hour precipitation <br />event. The term ^!0-year. 24-hour pre- <br />cipitation event" means the maximum <br />24-hour precipitation event with a <br />probable reoccurrence interval of <br />once in 10 years. <br />within 90 days of the effective date <br />of the permit, the permittee Shall <br />submit verification that the facility <br />has been designed, constructed and <br />maintained in accordance with the cri- <br />teria above. This verification shall <br />also identify the gauge station used <br />and the 10-year, 24-hour precipitation <br />figure (in inches of rain). Such veri- <br />fication may be in the form of a letter <br />or other indication from the Colorado <br />Mined Land Reclamation Board, the Fed- <br />eral Office of Surface Mining, the Fed- <br />eral Environmental Protection agency, <br />or other appropriate agency acceptaole <br />to the Colorado water Quality Control <br />Oivision• stating that the above cri- <br />teria have been met. <br />GEASE_AtiII_QESISI_Q3QEfl <br />Based upon the foregoing findings of fact and notice <br />of violation, and pursuant to the provisions of G.R.S. 1973• <br />28-8-605 (Supp. 1981)• 1 hereby order you to: <br />1. immediately cease and desist violating <br />part 1.A.1 of your permit. <br />2. advise the division in writing, within 30 <br />days after issuance of this order, of the measures you have <br />taken to Comply with paragraph 1 of this order.
