In a letter to the division dated July lb. L981, <br />a copy of which is attached as exhibit Ar Yampa stated that <br />it was submitting verification that its facilities had been <br />designed, constructed and maintained to contain or treat <br />the volume of water from its active mining areas, preparation <br />plants and associated areas which would result from a 10-year. <br />24-hour precipitation event. In a letter dated October 2, <br />1981• the division notified Vampa that the information sub- <br />mittea in its July lb letter was incomplete. A copy of the <br />October 2 letter is attached as exhibit B and incorporated <br />herein Dy reference. <br />6. Yampa has still not Submitted to the division <br />adequate verification that the facilities at the mines have <br />been designed, constructed and maintained to contain or <br />treat the volume of water from active mining areas, prepara- <br />tion plants and associated areas which would result from a <br />10-year, c4-hour precipitation event. vamps also has not <br />identified number of inches of rain that would fall in the <br />Bred Of the mine5 In the eVen2 Of a 10-year• [4-hour precipi- <br />tation event. the term "10-year, 24-hour precipitation <br />event" means the maximum 24-hour precipitation event with a <br />probable reoccurrence interval of once in !0 years. <br />~IIIIlLE_I2E_YtQL9ItilY <br />You are hereby notified that the facts stated above <br />constitute 52 violations of the permit, as set forth below: <br />1.
