<br />RESPONSE: <br />The requested information is shown on revised Map 4a, Energy <br />Mine No. 3 Hydrology (1" = 500' scale), revised Map 20a, Permanent <br />Sediment Control Plan (1" = 200' scale), revised Figure 4a of <br />Exhibit 3, Middle Creek Hine Detention Basin Conceptual Design (1" _ <br />50' scale) and revised Figure 3a of Exhibit 3, Mine No. 3 Detention <br />Basin Stage-Storage Diagram (1" = SO' scale). Specifically, the <br />inside contours of the pond, bottom elevation of the pond, ditch <br />inflow points, spillway and embankment details, and pond location <br />with respect to Middle Creek are shown on Figures 3a and 4a of <br />Exhibit 3. <br />3. The fact that these ponds are proposed permanent ponds should be <br />discussed in the permit application itself, and not just in Exhibit 3. <br />RESPONSE: <br />The design construction, maintenance and operation of the <br />proposed detention basins ie discussed in revised Section 2.05.3(4), <br />under the heading, "Permanent Impoundments". <br />4. The 10-year, 24-hour storm must be contained in the ponds. If high <br />inflows result in water levels above the level required to allow adequate <br />storage of this storm, provisions must be made in the permit application <br />to dewater the ponds to the necessary level. <br />RESPONSE <br />The Mine No. 3 and Middle Creek Mine Detention Basins are <br />designed to contain the runoff resulting from the 25-year, 24-hour <br />-28- <br />
