Graham: <br />I would like to respond to your letter of April 19, 1982 and a recent <br />development which could affect your request for a hearing on the permit <br />area of Trinidad Basin Mining. <br />In conversations with Mr. Ben Quinn, wtio is preparing the permit for <br />Trinidad Basin, he stated that Trinidad Basin is no longer proposing <br />any operations be conducted on your land. He conveyed to me that Trinidad <br />Basin believed thaC the land was part of a lease agreement with hir. Alvin <br />Wiggins. <br />If this is acceptable to you, (that no operations be conducted on your <br />land) it appears that a hearing would not be necessary. <br />To address your second concern, the Division conducts monthly inspections <br />of the coal mining operations in Colorado, in addition to holding a <br />reclamation bond on all operations. Should the operation not live up <br />to its mining and reclamation obligations, the Division has legal <br />recourse which can be pursued to insure adequate reclamation of the <br />mined land. <br />If the Division can be of further assistance please co~itact us. <br />Si/n~ce~re~ly~ <br />Michael S.
