we were to operate as Sunbelt did with coal all <br />over the place then we would pick this up and <br />carry it to the sediment pond. As our mine is <br />set-up once the coal is mined it will stay in <br />concrete storage bins until loaded out Eor <br />shipment, so the coal should never hit the ground <br />from mining until it leaves the property to the <br />customer. As far as mine wastes entering the <br />sediment pond, this should not happen. The water <br />in the pond will contain sediment from exposed <br />cuts or runoff from roads. The Hay Gulch Ditch <br />also carries this type of sediment and is used <br />for stock watering. No animals in this area have <br />died due to drinking this water. We will commit <br />to complying with the State Engineer's office in <br />regards to this pond. The statements in regards <br />to the impondment will be changed on pages 4.05-7 <br />and 4-16 and are included in this letter. <br />16. On his visit to the mine this week John Doerfer <br />and I had some discussions on the acid water that <br />we are making from a seep below the coal seam and <br />I think that we have worked out a plan between us <br />to build two small holding ponds beside the road <br />where this water can be contained and treated with <br />lime to bring up the P11 levels. <br />17. We are presently looking into the drainage problems <br />related with getting the water from the mine bench <br />to the loadout area. We are thinking of installing <br />culvert Erom the mine bench to the loadout area, <br />with concrete inlet and outlet. <br />18. We will include in the mining permit our requests <br />for keeping the coal. bins and scales after mining <br />is complete. Please find the needed discussion. <br />19. Task #4. We do not agree with this estimate and <br />have enclosed two bids from local contractors <br />that are good for three years. <br />Task #11. We agree. <br />Task #12. We agree. <br />Task #14. We agree. <br />With the enclosed estimates we Eeel that the Bond <br />should be in the $50,000.00 area rather than the <br />$58,200,00 you have derived. <br />20. We will be glad to mulch at the rate of 4,000 lbs. <br />per acre. But, we have been told that being as <br />arid as we are in this area that nothing will <br />survive at the 4,000 lbs. per acre. I have no <br />experience at growing vegetation in this area <br />and I don't think the di.vi.sion has either, so T'm <br />-3- <br />
