Reply to Second Adequacy Letter File # C87-072 <br />l.a. Map #2 has been changed to reflect the Sarver lease. <br />l.b. Dugan Production i.s part of the partnership that <br />owns the minesite, so in turn is part of La Plata <br />Coal Corporation. These lands are deplicted as <br />being owned by La Plata Coal Corp. which they are. <br />l.c. The area where the portals are located is La Plata <br />Coal Corp. property conveyed by the Leach title <br />about 400 ft. is through a La Plata County Lease <br />with La Plata Coal Corporation. <br />2. The Leach deed dated 1.1-17-86 gives us control of <br />the surface area of the minesite and the portal <br />area. The Dugan deed and Sarver Lease give us the <br />the right to mine coal in Section 28 N ; SW ~: <br />SW/4 NW/4 Section 29: SE/4 NE/4: N2 SE/4. Deed <br />dated 4-27-87 from Valley Welding to La Plata Coal <br />give us the surface and coal Nz NEB SW~ NE} of <br />Section 29. <br />3. The bottom of this lease was omitted by the request <br />of Tony and Barbara Sarver and approved by Mike Savage. <br />The Sarvers do not feel that it is public information. <br />4. The Leach title is clear and we do have market- <br />ability of this property. <br />5. Map 10 will be revised to omit the Federal Coal. <br />6. Enclosed please find Letter from S.C.S. stating <br />that we have no prime farmlands on our property. <br />7. Please find Wayne Dale's report attached. <br />B-1 This has been changed to reflect a 60°l, Private and <br />40% Indian Surface. <br />2. Jack Wiltse address is as follows. <br />2614 E. 20 Farmington New Mexico. <br />3. At the beginning of this letter we stated all interests <br />that we o~an or lease. At present we don't intend to <br />pursue any further interests. <br />4. Our insurance agent has or will contact Peter O'Connor. <br />5. Highwall material will not be present within three <br />feet of the surface of [he reclaimed backfill areas. <br />6. The Huntington Spring has been abandoned.
