Keschke: <br /> <br />The attached Draft Findings Uocument represents the final stage of the <br />Division's permit review for the Red Canyon f4ine. Items noted as <br />adequacy issues require information or modifications to the permit which <br />can and must be submitted prior to permit issuance. These adequacy <br />issues will not be included in the Final Findings of Compliance. <br />Information requested by adequacy issues is necessary to allow the <br />Division to make the required findings of compliance. Stipulations <br />require information to be submitted subsequent to permit issuance and <br />will probably be included in the final document. <br />Une signficant issue which must be resolved prior to publication of the <br />Division's proposed decision regards the Delta load-out facility. <br />Upon permit issuance, the Division will assume regulatory jurisdictioh <br />over the load-out. Information regarding operations and sediment control <br />at the load-out has been provided. However, certain additional <br />infonnation should be submitted prior to preparation of the final <br />Findings Uocument. The application fonn should include the general <br />location and acreage of the load-out. A legal description and <br />information on ownership/right-of-entry and an updated air pollution <br />control plan (as required by the Health Department) should be <br />incorporated in appropriate sections of the application. <br />Also, it is apparent from Map No. 2.U5.3(7j-1 that the proposed permit <br />area at the load-out is within l0U feet of puulic roads and within 3UU <br />feet of private residences in Delta. <br />Pursuant to Rule 2.01.6(2)(d)(v), all owners of occupied dwellings within <br />3UU feet of the proposed permit boundary must provide a written waiver(s) <br />consenting to the surface coal mining operations closer than 3U0 feet. <br />The waiver(s) must be submitted to the Division prior to permit issuance. <br />4?~ CentenniRl Building 1313 Sherman Strrcl Ilrn~~er (:nlnradn 80703 Tel (9f,~1 nfFi 3Sfi7 <br />
