Box 56 <br />Bostic, North Carolina 28018 <br />RE: Seneca II-W Mine <br />Our File No. C-057-82 <br />Dear Mrs. Hudson: <br />Pursuant to section 34-33-114 of the Colorado Surface Coal Mining Reclamation <br />Act, this letter is to inform you of the Mined Land Reclamation Division's <br />proposed decision to approve a permit for a surface coal mining operation. <br />The operation in question is Peabody Coal Company's Seneca II-W Mine and <br />associated haul road. <br />Enclosed is a copy of the "Proposed Decision and Findings of Compliance" for <br />this mine. Peabody Coal Company submitted information with the permit <br />application showing that Temple Well No. 1, registered in the name of Fay S. <br />Temple, will be destroyed by mining. It is the Division's understanding that <br />you and Daisy J. Epps currently hold this water right. Under section VII, <br />Water Rights and Replacement (pg. 23), the Division is requiring Peabody to <br />provide a mitigation plan to ensure this right. <br />The Decision Document is being sent to you and Daisy J.
