.. C. Evaluation of Compliance Applicant's Compliance ' The applicant has provided adequate information and Ss therefore !n ~ compliance. OSM Compliance Compliance has been initiated. OSIi has fon:arded to the Colorado SIiPO a request for a "No Effect," "No Adverse Effect" concurrence. If the SHPO concurs, OSM will be in compliance with the National Historic Preservation Act and the Programmatic Plemorandum of Agreement. D. Revisions to Applicant's Proposal If the plan is approved the applicant will carry out stipulations identified in Section F. E. Revaluation~to Compliance when the Colorado SHPO's response is received, and there is no disagreement, OSti compliance activities will be complet:. F. Proposed Special Stipulations 1. If, during the course of operations, previously unidentified cultural resources are discovered, the applicant shall insure that the site is not disturbed and-shall notify the"OSti. The operator shall insure that the resource(s) is properly evaluated in terms of the National Register of Historic Places eligibility criteria (36 CFR 60.6). Should a resource be determined eligible for listing Sn consultation with the OSM and the SHPO, the operator shall confer with and obtain the approval of the OSti and the SHPO concerning the development and implementation of mitigation measures as appropriate. If previously unplanned surface disturbing activi[es are necessary, the applicant shall submit a justification and maps showing the proposed disturbance to [he OSIi for their approval prior to the commencement of these activities.• 2. At present, sites SG741 and SGF742 (both recommended as eligible for nomination to the National Register) will not be directly affected by proposed mining activities. If this should change, however, and one or both of the sites become endangered by mining activities, a mitigation plan will need to be presented by the company to deal with these sites. 3. Sheridan Enterprises shall issue instructions to all employees and subcontractors that vandalism of cultural resources (e.g., artifact collection, ground surface disturbance within site boundaries, structural modifications or defacement) is strictly contrary to company policy.
