Evaluation of Compliance <br /> <br />Applicant's Compliance ' <br />The applicant has provided adequate information and Ss therefore !n <br />~ compliance. <br />OSM Compliance <br />Compliance has been initiated. OSIi has fon:arded to the Colorado SIiPO a <br />request for a "No Effect," "No Adverse Effect" concurrence. If the SHPO <br />concurs, OSM will be in compliance with the National Historic Preservation Act <br />and the Programmatic Plemorandum of Agreement. <br />D. Revisions to Applicant's Proposal <br />If the plan is approved the applicant will carry out stipulations identified <br />in Section F. <br />E. Revaluation~to Compliance <br />when the Colorado SHPO's response is received, and there is no disagreement, <br />OSti compliance activities will be complet:. <br />F. Proposed Special Stipulations <br />1. If, during the course of operations, previously unidentified cultural <br />resources are discovered, the applicant shall insure that the site is not <br />disturbed and-shall notify the"OSti. The operator shall insure that the <br />resource(s) is properly evaluated in terms of the National Register of <br />Historic Places eligibility criteria (36 CFR 60.6). Should a resource be <br />determined eligible for listing Sn consultation with the OSM and the SHPO, <br />the operator shall confer with and obtain the approval of the OSti and the <br />SHPO concerning the development and implementation of mitigation measures <br />as appropriate. If previously unplanned surface disturbing activi[es are <br />necessary, the applicant shall submit a justification and maps showing the <br />proposed disturbance to [he OSIi for their approval prior to the <br />commencement of these activities.• <br />2. At present, sites SG741 and SGF742 (both recommended as eligible for <br />nomination to the National Register) will not be directly affected by <br />proposed mining activities. If this should change, however, and one or <br />both of the sites become endangered by mining activities, a mitigation <br />plan will need to be presented by the company to deal with these sites. <br />3. Sheridan Enterprises shall issue instructions to all employees and <br />subcontractors that vandalism of cultural resources (e.g., artifact <br />collection, ground surface disturbance within site boundaries, structural <br />modifications or defacement) is strictly contrary to company policy. <br /> <br /> <br />
