The Assistant Secretary determines tY.at approval of the Energy No. <br />1, Energy No. 2 and Eckman Park mines mining elan, as modified, <br />including the operation and reclamation plan portion of the permit <br />application, complies with the Hineral Leasing Act of 1920, as <br />amended, the terms of the lease, the Federal Lands Program, and a'_1 <br />other requirements of applicable Federal laws. (See Office of <br />Surface Mining Reclamatior. and Enforcement Findings and Bureau of <br />Land Management letter dated September 4, 1985.) <br />2. The Department has considered the effect of a decision on the <br />mining plan, as modified, on historic properties in accordance with <br />the National Historic Preservation Act. (See State Historic <br />Preservation Officer letter dated February 8, 1980.) <br />3. The proposed operation is not likely to jeopardize the continued <br />existence of threatened or endangered species or result in the <br />destruction or adverse modification of their critical habitats, as <br />determined under the Endangered Species Act of 1973 (16 U.S.C. 1531 <br />et sec.).
