Chandler
1205 Western Avenue
Trinidad, Colorado 81082
Rte: Comment on Proposed Rimrock Strip 14ine
Dear Mr, and Mrs. Chandler:
This is to acknowledge receipt of your letter dated September 16, 1989 in
regard to the proposed Rimrock Strip tdine. The Division is indeed in the
process of considering the apolication fora permit to conduct mining and
reclamation operations by the operator of this mine. There area pumper of
issues still to be resolved in regard to the proposed operation, and i*_ is by
no means certain at this time that the application will be approved. If the
Division, however, does determine that the ooeration mee*_s the repuiremen*_s of
the Regulations of the Colorado Mined Land keciamation Board for Coal 14ininp
and proposes to approve the apolication, public announcements will be mane in
the Trinidad newspaper, and a cony of the written Division's Findings in
reoard to the application will be made available locally. You may be
satisfied at that time that the issues you have raised 'nave been DrpDerly
addressed. If not, the public announcement of the decision initiates z 30 day
period during which anyone adversely impacted may so notify the Division and
reouest a formal hearing on the decision before the Colorado Mined Land
Reclamation Board. If such a reouest is made, the Division's decision is pct
final unless affirmed by the Board following a formal DllDI]C hearinc.
The concerns that you nave in reoard to the proposed operation are certainly
understandable, but are perhaps more properly addressed at the local level.
Regardless of the Division's decision, the Rimrock Mine cannot proceed witno~*_--
havinp county approval. You should be aware, However, thzt some local
consideration has been made. A special use permit for the mine was issued by
the Board of Lzs Animas County Commissioners July 10, 1987.
If i may be of any further help in this matter, please contact me.
Sincerely,/
James C.
