A review of our records <br />revealed no suspended or revoked permits, bond forfeitures, outstanding cessation orders, unpaid <br />Abandoned Mine Land fees or past due civil penalties for any operation owned or controlled by <br />the owners, officers, or directors of the subject company. However, Tennessee Mining, Inc., a <br />company under common control with the subject company, has an outstanding Notice of <br />Violation, N96-090-087-006, which has an abatement due date of July 1, 1996. We contacted the <br />State of Tennessee, Division of Water Pollution Control regarding water quality violations on <br />surface coal mining operations, and were informed that none are outstanding at this time. <br />Addington Enterprises, Inc., a company under common control with the subject company, has <br />recently submitted permit applications to this office. The list of surface coal mining operations <br />within the past five years submitted as part of those applications is different from the list that you <br />enclosed with your letter. I have enclosed the latest list that we received. While some <br />discrepancies still exist in the information contained m the list, we consider the application <br />administratively complete.
