• <br />Danr•r <br />-3- <br />Land Reclamation Division to demonstrate that the Eagle N,o. 6, <br />Eagle No. 7, or F.agle No. S mines meet the coal production or <br />permit approval criteria required by Section 114(2)(e)(II). <br />2. As stated in G.R.S. 1973, 34-33-114(2)(e)(II), surface coal <br />mining operations meeting the coal production or permit <br />approval criteria are exempted from the requirements of <br />Section 114(2)(e)(I). In essence, an exemption allows <br />access to the coal resource without requiring the Division <br />to make a determination of the impact of resource extraction <br />on agricultural activites or material damage to the <br />hydrologic balance of an alluvial valley floor. In the <br />case of an exemption not being allowed, access to the <br />coal resource might be denied if the Division, found that <br />surface coal mining operations would cause significant <br />impact to the continuation of existing agricultural <br />activities in the alluvial or cause materiel damage to <br />the quantity or quality of the surface and ground waters <br />that supply an alluvial valley flood that contains <br />.~ - significant existing agriculture. <br />Since an exemption is only effective for the requirements of <br />C.IC .N .I/CI ~'.~~••o f'n •I Y11dfi..l ~'1 v1~~•N-:~ <br />Section 114(2)(e)(I), ( mi must meet the <br />remaining requirements of the Act regarding the protection^o~ <br />be designed to prevent material damage to the hydrologic balance <br />outside the permit area (114(2)(c)) and preserve -a..;~.~=' '--' <br />- throughout the mining and reclamation ~ process the <br />essential hydrologic functions of alluvial valley floors (~20(2)(j)(vi)). <br />To demonstrate compliance, for the exempted Eagle No. S and Eagle <br />No. 9 mines~hmust~dentify all alluvial valley floors in or adjacent <br />~I ~~ I ~ I ~. ~ 11 ~ <br />
