This permit is issued to permit an existing access. The <br />access will serve one (1) Surface and Underground coal <br />Mining operation. <br />2. No new construction or improvements are required by the <br />issuance of this permit. <br />-~ 3. Incorporated as part of this permit are the following: <br />Application for Access Permit (CDOT Form No. 137), dated May <br />3, 1997. <br />Both Bides of the Permit (CDOT Form No. lol). <br />Permit Terms and Conditions (Page 2). <br />4. This Permit is issued in accordance with the State Highway <br />Access Code, and is based in part upon the information <br />submitted by the Permittee. This Permit is only for the use <br />and purpose stated in the Application and Permit. Any <br />changes in traffic volumes, drainage, types of traffic or <br />other operational aspects may render this permit void, <br />requiring a new Application for Access Permit to be <br />submitted for review by this o£f ice, based upon existing and <br />anticipated future conditions. PLEASE NOTE ACCESS CODE <br />INFORMATION ON THE REVERSE SIDE OF THE PERMIT FORM. <br />5. The Permittee shall refer to all additional standard <br />requirements on the back of this Permit and any enclosed <br />additional terms, conditions, exhibits and noted <br />attachments. <br />6. Backing maneuvers within and into the State Highway <br />right-of-way are strictly prohibited. All vehicles shall <br />enter and exit the highway right-of-way in a forward <br />movement. sacking into the right-of-way shall be considered <br />a violation of the Terms and Conditions of this Access <br />Permit and may result in revocation of the Permit by the <br />Department and/or the issuing authority. <br />7. Left turn movements in and out of this access may be <br />prohibited at some future date. <br />8. A FULLY EXECUTED COMPLETE COPY OF THIS PERMIT MUST BE <br />AVAILABLE UPON REQUEST BY THE DEPARTMENT INSPECTOR OR THE <br />ISSUING AUTHORITY. (Fully executed means, a Colorado <br />Department of Transportation (CDOT) Access Permit number <br />assigned to the permit, stamped "PAID", and signed and dated <br />by both the Permittee and an authorized representative of <br />CDOT). <br />9. Any additional permits and clearances required by other <br />Federal, State, Local Government Agencies or Ditch Companies <br />are the responsibility of the applicant and property nwner_ <br />10. The Permittee is responsible for obtaining any necessary <br />additional federal, state and/or City/County permits or <br />clearances required for construction of the access. <br />Approval of this access permit does not constitute <br />verification of this action by the Permittee. <br />11. No drainage from this site shall enter onto the surface of <br />the highway. <br />12. it is the responsibility of the property owner to prevent <br />all livestock from entering the State Highway right-of-way. <br />Any livestock that do enter the highway right-of-way are the <br />responsibility of the property owner. <br />TOTRL P.04 <br />
