Lockhart: <br />Re: Colorado-Yampa Coal Company's <br />Fieersency Bq-Faso Rcqueat <br />Thanks for pour pnrticipation during the field meeting held at Colorado-Yampa <br />Coal Company on 9/20/84 to discuss mitigating measures to ensure protection of <br />the active prairie falcon nest site in T42:, R86S~, Section 9, sFJ;si.'k. This <br />letter confirms protective stipulations mutually agreed to at the meeting. I <br />am recocm~ending rtes following coal lease stipulation: <br />In order to protect the active prairie falcon neat site, no activity <br />shall be permitted within 100 feet of the northwest side of the ridge- <br />top. Frior to mining, the lessee, in consultation with the DLtI, USC[+S, <br />and L04J, will develop a monitoring study to detemine the effects of <br />mining on the falcon nest site.
