Since receiving your request fot information on this <br />application, we have reviewed the application of Criterion 13 on this 40 <br />acres. After consultation with the Fish and Wildlife Service, we are <br />reversing our decision and applying the exception far Criterion 13. The <br />nest is question will be protected through lease stipulations. <br />Proposed coal Lease C-37180 is a maintenance tract for Colorado Yampa Coal <br />Co. The proposed lease is an effort to make available, through competitive <br />lease sale, all unleased surface mineable reserves adjacent to the south end <br />of mine. If C-37180 is not leased timely, these reserves would also be in a <br />bypass situation. .Therefore, the land applied for in the application fits <br />in with the proposed coal lease. <br />Revising the boundary of C-37180, by adding the 40 acres, does not <br />significantly change the proposed lease. We, therefore, would not <br />anticipate amending Che Tract Profile/Site Specific Analysis or GR-IIF round <br />II EIS, if the applied for lands are added to the proposed lease. <br />We have contacted Cetty 011 Company and discussed our recommendation with <br />them. We have not received their position on this subject, but expect to <br />within a week. As soon as we receive their position, we will contact your <br />staff. '. <br /> <br />Exhibit A <br />
