Box 47480 <br />Dallas, Texas 75247 <br />RE: Letter of Credit 111350, Files 78-175 (sic), 78-145 s/c, and 77-28 <br />(Alvin idiggins and/or Del Agua Coal Company) <br />Dear Sirs: <br />I have been contacted by Mr. Sjaastad on behalf of Pir. [~iggins regarding <br />the above referenced letter of credit. I have researched our files of <br />reclamation bonds on file with the State Treasurer. This file includes <br />all forms of bonds submitted by operators to cover reclamation (i. e.; <br />letter of credit, cashiers checks, certificates of deposit, etc.). <br />Nowhere in this file does the above bond appear. According to the <br />Administrative Assistant for the Division, Ms. Diana Heyer, this indicates <br />that the bond has been released by the Division. <br />Pit. [Jiggins is no longer involved in any of the ongoing mining operations <br />at the site of the former Del Agua mine except as the surface landowner <br />who has a lease agreement with the current operators, Trinidad Basin <br />Pfining, Inc. 'frinidad Basin I9 fining, Inc. maintains a reclamation bond <br />to cover their operations and is currently in the process of permitting <br />operations in the area of the old De] Agua mine, which will be bonded <br />also. <br />Lastly, Mr. i•]iggins does not have any current permits with the Division. <br />If I can be of any further assistance please Ceel free to contact me. <br />Sincerely, <br />~~ ~~~ <br />Michael S.
