November 26, 19R0
~1r. Kent A. Crofts
Energy Fuels Corporation
Box l'
Steamboat Springs. Colorado 80477
Dear Kent:
This letter is in response to Energy Fuels submission for bond
release on areas at the T.nercy Fuels No. 3 dine. l9e were favor-
ibly impressed with the revegetation efforts on all the areas we
viewed (areas A-~ on your bond release mapl. In view of the fact
that these areas fall under the 1976 Colorado 1•tined Land Reclamation
Act and the ].978 Rules and Regulations pursuant to that act, the
staff feels that the reptiiremants for reve~etation (Rule fi.5,
statute llfi(1)(f) have been met. We find that the existing vegeta-
tion is diverse, effective, and gong-lasting and capah].e of self
rn~eneration. Also, the existing vegetation is at least equal in
cover to the natural vegetation of the surroitndir.g area.
!'oncern has been expressed regarding the ground cracks encountered
in Bond P.clease area. ].). These cracks were of sir;nificant dentlt
(??S") and length (un to 150'). The staff iaould like Energy Fuels
to respond to these concerns, by addressing the (1) cause of these
fractures: (~) the stability of the slope on which the fractures
occurred: and (3) the potential for further occurence of settling,
dovrnslo*+e movement, and rotational movement.
At this point the staff can recommend Rond release on all areas
except area D (due to the stability concerns expressed above).
-Iowever, with 2dequate.:re~olution_o'f the _c oncerr~s_-,re.'4a~r(clinR a~ea h,~-
t7te staff can recommend hnnd release for area '1 als'q.~
Sincerely.
^,obert Liddle and Michael Savaz~
Reclamation Specialists
RL:MS:mab
