Adequacy <br />-8- <br />March 5, 1985 <br />.4 The Livestock and Water Tank Act passed in the early 1970's allowed <br />farmers with small stock ponds which did not drain to a perennial <br />Stream an undeclared water right. The applicant will be eliminating <br />several small stock ponds during mining. Pond 006 will replace the one <br />pond with an existing water right. Peabody will need to replace all <br />other stockponds destroyed during mining. <br />Alluvial Palley Floors - Rule 2.06.8(3) <br />1. The first paragraph on page 7-195 states that mining will be limited to <br />the Dry Creek watershed. This does not appear to be correct. Runoff <br />from disturbed areas will be limited to Dry Creek watershed, but a <br />small portion of mining will take place in the Sage Creek drainage. <br />2. How does the six acres of hayland being taken out of production by the <br />tie-across haul road compare to the total farming unit? <br />Bonding - Rule 3.02.2 <br />1. Please refer to comments under 2.05.4(2)(b) above. <br />Roads - Rule 4.03 <br />1. Haul Road D has an approximately 1800 foot section starting at Station <br />30+00 which shows a 0% slope. The drainage ditch in this area must <br />have a slope in order to drain and it appears that this will create a <br />ditch which will be progressively deeper. <br />2. Was the stream channel at the beginning of the mine entrance road <br />rechannelized? From the entrance road maps it appears that the road <br />overlays the stream in several areas. <br />3. The topsoil stockpiles shown on the tie-across haul road cross <br />sections, Exhibits 12-9-1 through 12-9-8 should also be shown on <br />Exhibit 7-10A Hydrologic Control Plan, Tie Across Haul Road. <br />1 <br />4. Details for Haul Road A Ditch Containment Berm should be presented in <br />the permit application. <br />
