SHELTON, Director March 5, 1985 Mr. Tom Wainwright Peabody Coal Company 10375 East Harvard Avenue Suite 400 Denver, Colorado 80231 Re: Seneca II-W Mine File No.: C-82-057 Preliminary Adequacy Review Dear Mr. Wainwright: The above referenced permit application has been reviewed by the Mined Land Reclamation Division for compliance with the regulations promulgated pursuant to the Colorado Surface Coal Mining Reclamation Act, C.R.S. 34-33-101 et seq. This letter and attached comments convey the concerns raised during the adequacy review as required under Rule 2.07.4(1). Additional information may be requested as the review continues. Enclosed are several comments from the Division of Wildlife and the State Engineer's office. The Division received no comments from other agencies who reviewed the application. As these comments are received I will forward them to you. The Division has received several letters of public comment on the proposed Seneca II-W mine. Copies of these letters are enclosed for your information. Peabody's response must be submitted and the issues resolved before the Division can make a decision on this permit application. In a letter dated February 11, 1985, the Division responded to concerns raised by Mr. Wallis L. Campbell on behalf of Mr. Fletcher Scott. A copy of this letter was forwarded to you. We believe that this matter has been resolved. As in past submittals, all responses to review should be presented as revisions submissions.
