SHELTON, Director <br />March 5, 1985 <br />Mr. Tom Wainwright <br />Peabody Coal Company <br />10375 East Harvard Avenue <br />Suite 400 <br />Denver, Colorado 80231 <br />Re: Seneca II-W Mine <br />File No.: C-82-057 <br />Preliminary Adequacy Review <br />Dear Mr. Wainwright: <br />The above referenced permit application has been reviewed by the Mined Land <br />Reclamation Division for compliance with the regulations promulgated pursuant <br />to the Colorado Surface Coal Mining Reclamation Act, C.R.S. 34-33-101 et seq. <br />This letter and attached comments convey the concerns raised during the <br />adequacy review as required under Rule 2.07.4(1). Additional information may <br />be requested as the review continues. <br />Enclosed are several comments from the Division of Wildlife and the State <br />Engineer's office. The Division received no comments from other agencies who <br />reviewed the application. As these comments are received I will forward them <br />to you. The Division has received several letters of public comment on the <br />proposed Seneca II-W mine. Copies of these letters are enclosed for your <br />information. Peabody's response must be submitted and the issues resolved <br />before the Division can make a decision on this permit application. <br />In a letter dated February 11, 1985, the Division responded to concerns raised <br />by Mr. Wallis L. Campbell on behalf of Mr. Fletcher Scott. A copy of this <br />letter was forwarded to you. We believe that this matter has been resolved. <br />As in past submittals, all responses to <br />review should be presented as revisions <br />submissions.
