Banta, <br />Division Director <br />In response to your request of August 13, 199 I am providing a clarification <br />on the status and standing of the Eastside Mine permit. <br />Currently, there are no unresolved enforcement actions that have been issued <br />to Eastside from the Division. Based on the Division's inspections and <br />knowledge of the permit, Eastside is in compliance with the requirements of <br />the permit and statute (Colorado Surface Coal Mining and Reclamation Act). <br />With regard to the recent permit renewal, the Division issued a proposed <br />decision to renew the permit on February 1, 1990. On March 13, 1990 the <br />Division received a request for a public hearing on the staff's recommendation <br />to renew the permit from Mr. Greg McKennis. Mr. McKennis alleged that <br />Eastside had not provided accurate information regaraing the ownership of <br />Eastside Coal, that Eastside did not have a valid county permit to mine, that <br />Eastside had not paid its workers, that Eastside was in poor financial <br />condition, and that Eastside had made conflicting statements to county <br />officials regarding mining plans. Of the above concerns, only the ownership <br />issue was under the Direct jurisdiction of the Mined Land Reclamation Division. <br />A formal public hearing was held before the Colorado Mined Land Reclamation <br />Board on April 25, 1990 to address the ownership issue. Mr. McKennis and Mr. <br />Randy Corry addressed the Board regarding the concerns as did Mr. Steven Self <br />of Eastside Coai. At this meeting the Board requested additional <br />clarification of the ownership and control of Eastside Coal Co., Eastside <br />Energy, and Abraxas Petroleum and continued the discussion until May 23, 1990. <br />The information requested by the Board was provided to the Division, the <br />Board, and the citizen objectors on or about April 30, 1990. At the May 23, <br />1990 continuation of the hearing the Board upheld the Division's <br />recommendation to issue the renewed permit. The renewed permit was issued <br />June 29, 1990. <br />
