In response to your request of August 13, 199 I am providing a clarification
on the status and standing of the Eastside Mine permit.
Currently, there are no unresolved enforcement actions that have been issued
to Eastside from the Division. Based on the Division's inspections and
knowledge of the permit, Eastside is in compliance with the requirements of
the permit and statute (Colorado Surface Coal Mining and Reclamation Act).
With regard to the recent permit renewal, the Division issued a proposed
decision to renew the permit on February 1, 1990. On March 13, 1990 the
Division received a request for a public hearing on the staff's recommendation
to renew the permit from Mr. Greg McKennis. Mr. McKennis alleged that
Eastside had not provided accurate information regaraing the ownership of
Eastside Coal, that Eastside did not have a valid county permit to mine, that
Eastside had not paid its workers, that Eastside was in poor financial
condition, and that Eastside had made conflicting statements to county
officials regarding mining plans. Of the above concerns, only the ownership
issue was under the Direct jurisdiction of the Mined Land Reclamation Division.
A formal public hearing was held before the Colorado Mined Land Reclamation
Board on April 25, 1990 to address the ownership issue. Mr. McKennis and Mr.
Randy Corry addressed the Board regarding the concerns as did Mr. Steven Self
of Eastside Coai. At this meeting the Board requested additional
clarification of the ownership and control of Eastside Coal Co., Eastside
Energy, and Abraxas Petroleum and continued the discussion until May 23, 1990.
The information requested by the Board was provided to the Division, the
Board, and the citizen objectors on or about April 30, 1990. At the May 23,
1990 continuation of the hearing the Board upheld the Division's
recommendation to issue the renewed permit. The renewed permit was issued
June 29, 1990.
