<br />ADEQUACY REVIEW <br />Blue Flame Mine <br />C-81-053 <br />Application Form <br />1. The most recent application form we have was received June 11, 1984. <br />Since a considerable amount of time has elapsed since this form was <br />received, we have enclosed a blank form for execution. <br />2. The public office specified under point 13 should be the La Plata County <br />Courthouse and not the Division's office. Pease change the application <br />to reflect Office of the County Clerk & Recorder, La Plata County <br />Courthouse, 1060 East Second Avenue, Durango, Colorado 81301. <br />3. The acreage of disturbed area under Point 14 should include the two bench <br />areas and the access road from County Road 120 to the mine benches. The <br />application form currently specified a disturbed acreage of "less than <br />two (2) acres". Page 1 of Exhibit B specifies 3.0+/- acres have been <br />disturbed by the mine benches and the access road disturbed an additional <br />0.5 acres. Please revise this point to accurately reflect total acreage <br />disturbance. Also, if both access roads are to be used (i.e. the one <br />directly from County Road 120 to the benches and the one from National <br />King Coal to the benches), please add in the additional acreage. <br />4. Points 15 and 16 specify an acreage of "less than 40 acres". The acreage <br />listed for these two points should be a specific acreage that includes <br />the actual surface disturbance, the previously mined underground <br />workings, and the proposed underground workings. <br />5. Point 17 specifies an application fee of E275.00. We checked our records <br />and cannot find a receipt for this amount. Please submit a copy of the <br />receipt or copy of the cancelled check if this amount was previously <br />paid. Also, the correct amount should be $425.00 based on a basic fee of <br />$25.00 plus $10.00 for each of the 40 acres. Please submit the full <br />amount (assuming no change in acreage based on item 4 above) of $425.00 <br />or $150.00 plus a receipt or copy of the cancelled check for $275.00. <br />6. The "narrative" portions of pages 4-6 should be revised from "pending" to <br />referencing the applicable portion of the permit application. This can <br />be accomplished once Blue Flame changes application format from Exhibit <br />to Rule and Regulation notation. <br />2.03.3 Format and Supplemental Information <br />Please submit the information required by this rule, specifically Rule <br />2.03.3(4) and (6). <br />
