We
recommend that any adverse impacts to wetlands within the project influence be avoided.
Your letter also requests a list of species of high Federal interest. The following
species are considered migratory birds of high Federal interest in the Green River-Hams
Fork Coal Production Region, exclusive of species which are now federally listed or
designated candidates for Federal Listing.
Canvasback duck
5andhill crane
Golden eagle
Prairie falcon
Black crowned night hawk
Great blue heron
Osprey
Avthva valisineria
Grus canadenis
Auuila chrvsaetos
Falco mexicanus
Nvcticorax nycticorax
Ardea herodias
Pandion haliaetus
You should determine whether any of the activities associated with the load-out facility
will impact the above species or their habitat.
For your information, there is no designated critical habitat in the vicinity of the load-
out facility. Also, the conclusion of jeopardy or no jeopardy to federally listed species
is a conclusion made by the Fish and Wildlife Service in a biological opinion. This
determination will, therefore, be required only if formal consultation is required under
the Endangered Species Act.
We appreciate your attention to natural resource issues.
