Mine <br />Dear Messrs. Xline and Hagen: <br />As I discussed [yith you on Rugust 26, I want to formally inquire whether <br />the review of the Getty permit application for a proposed underground <br />coal mine, the Foidel Creek mine, should be conducted as a federal or <br />non-federal review. The permit application has recently been submitted <br />and a determination of federal involvement must be made, As I will <br />describe in greater detail, the circumstances for this mine are unique. <br />Although the mine will consist of totally fee coal and fee surface land <br />overlying the coal, it will share some limited surface facilities with <br />the existing Eckman Park mine. It is our interpretation, given the <br />current state of the regulations and the Colorado Cooperative Agreement, <br />that there is no required federal involvement in the review of the <br />application. <br />The Foidel Creek, underground mine will be located north of and adjacent <br />to the existing Eckman Part, surface mine. The Eckman Park mine consists <br />of a mixture of fee and federal coal, and surface ownership. The Eckman <br />Park mine is currently permitted under the federal permanent program and <br />is in compliance with the state permanent program. It is anticipated <br />that we will ma}:e the formal permit issuance for the Eckman Park mine <br />under the state conformity process simultaneous with the Foidel Creek <br />permit application approval. <br />The only activities related to the Foidel Creek mine which will occur <br />on federal Lands in the existing Eckman Park permit area are coal haulage <br />and certain limited sedimentation control. These facilities are <br />permitted under the Eckman Park permit, but are capable of handling the <br />proposed Foidel Creek activity. <br />u( i I <br />
